You did everything right. You drove carefully, followed the rules, and still got hit by someone who had no insurance. Now what?
Unfortunately, this is not a rare situation in Florida. The state has one of the highest rates of uninsured drivers in the country. If you’ve been injured by one of them, you still have options—but you need to move quickly.
Florida’s No-Fault System
Florida is a no-fault state, which means your own Personal Injury Protection (PIP) coverage is your first line of defense after any accident, regardless of who was at fault. PIP covers up to $10,000 in medical expenses and a portion of lost wages—but only if you seek treatment within 14 days of the crash.
That $10,000 can disappear fast, especially if your injuries are serious. So what happens when PIP isn’t enough and the other driver has no insurance?
Uninsured Motorist (UM) Coverage
If you purchased uninsured motorist coverage—and in Florida, you should—this is where it becomes essential. UM coverage steps in when the at-fault driver can’t pay. It can cover medical bills beyond what PIP covers, lost income, pain and suffering, and other damages.
Many people don’t realize they have UM coverage or don’t know how to use it. Insurance companies also don’t make it easy. Even your own insurer may push back on your claim or undervalue your injuries.
Can You Sue an Uninsured Driver Directly?
Technically, yes. But practically, it may not get you far. If the driver had no insurance, there’s a good chance they have limited assets to collect from. A judgment against them may be difficult—or impossible—to actually recover.
That said, every situation is different. I can investigate whether a lawsuit is worth pursuing alongside a UM claim.
What to Do Right Now
If you were hit by an uninsured driver, here are the steps that matter most:
- Get medical attention immediately—even if you feel okay
- Report the accident to your own insurance company
- Don’t give a recorded statement until you’ve spoken with a lawyer
- Contact an attorney who handles UM claims
